Apple vs. Samsung Lawsuit: Apple Seeks New Patent Infringement Trial for 14 Patents, Asks Judge to Reconsider Recent Ruling

Apple lawyers are busy at work with the ongoing patent infringement trial against Samsung and are asking the judge to reconsider her recent ruling.

According to latest reports, Apple is seeking for a new trial against the South Korean-based company for allegedly infringing 14 patents.

The judge for the San Jose, Calif. case, U.S. District Judge Lucy H. Koh, had partially overturned the jury's decision from a August 2012 verdict awarding Apple $1.05 billion. The decision involved 14 Samsung products.

Samsung issued an appeal and sought to put the case on hold, however, Apple said Samsung's request would "likely lead to a remand without a substantive decision [from the appeals court]."

As Latinos Post has been monitoring, Judge Koh reduced the $1.05 billion verdict by 40 percent. The percentage equates to approximately $450.5 million.

"It is not the proper role of the court to second-guess the jury's factual determination as to the proper amount of compensation," said Koh in the reduction ruling.

Apple, in a filing made on Tuesday, requests that if Judge Koh continues with the decision to reduce the billion dollar verdict then Samsung should not continue with their requested appeal. Apple further requested a possible reinstatement of the $85.3 million the jury awarded for Samsung's Galaxy S2 and Infuse 4G.

A trial has already been set for March 2014, which will feature devices such as Samsung's Galaxy S3 and Apple's iPhone 5.

The ongoing Apple vs. Samsung trial has gotten the tech business talking. Google Chairman Eric Schmidt commented on the matter as "unfair" on Apple's behalf.

"Now, I understand that there is a dispute over patents but to deny people the actual choice, literally you can't even choose our product versus another, strikes me as completely unfair and very much not what the patent system was really about," Schmidt said last week during a trip in Asia.
