Days after a stunning crash at the Daytona International Speedway in Daytona Beach, Fla., left more than 30 people injured, some of the spectators involved in the crash are pursuing legal action against NASCAR.
Three fans who were involved in the crash have hired the personal injury law firm Morgan and Morgan , while four others have made appointments with them, according to the Daytona Beach News Journal.
John Morgan, the firm's founder, told the newspaper that one of the three plaintiffs who hired the firm has a broken leg and another has a head injury while the third person also sustained unspecified injuries after driver Kyle Larson's car crashed into the wall during Saturday's Nationwide Series DRIVE4COPD 300 race.
The crash sent debris and a car tire through the 22-foot fence in front and into the stands where spectators were watching.
"When you go to a sporting event, if you are underneath the basket that's where your seat is and Shaquille O'Neal comes after a loose ball and dislocates your shoulder, you sat there knowing that was a risk," Morgan told the newspaper.
However, regarding the NASCAR incident, Morgan said that the fans expected that the fence would keep them safe, which was not the case.
The Associated Press reports that according to some legal experts, there may be grounds for a lawsuit, and courts have looked past liability waivers written on the backs of sporting event tickets. Others, however, argue that the ticket that Speedway fans paid for is a legal contract that could be hard to overcome in court.
Representatives from International Speedway Corp., which operates the Speedway, said that they have not received any legal notices indicating that a pending lawsuit was forthcoming.
