The Apple and Samsung patent infringement lawsuit has finally attracted the attention of the Finnish-based company Nokia.
Apple and Samsung have been locked in a patent infringement lawsuit across the globe. While cases have been dropped or resolved in some locations, the trial in San Jose, Calif. continues.
Ahead of the next Apple vs. Samsung trial in March 2014, Nokia has issued an amicus brief in regards to the trial. An amicus brief, according to WiseGeek, is a "document that is filed in a court by someone who is not directly related to the case under consideration."
Nokia has no part in the patent infringement trial in California, but it could be safe to say the verdict of the trial could affect all tech companies on how to issue a patent.
"Nokia's interest in this case is to advocate for patent laws that (i) protect patent rights as a means for promoting the constitutional goal of developing technology for public benefit; and (ii) foster and encourage innovation by allowing patent holders to obtain permanent injunctions against infringing competitors in appropriate circumstances," noted Nokia in their amicus brief, according to FOSS Patents.
Noting that the Finnish-based company takes "no position" on any of the substantive issues on the matter, Nokia added, "Nokia therefore supports the Appellant's [or Plaintiff's] request for reversal of the District Court's denial of a permanent injunction based on application of the wrong legal standard."
Nokia's statement comes as U.S. District Court Judge Lucy H. Koh ruled the $1.05 billion verdict would be cut by 40 percent. Apple won the billion-dollar verdict last August following a decision by a jury but the judge stated she believes the jury incorrectly calculated portions of the alleged infringed patents.
The 40 percent cut comes out to roughly $450.5 million.
"We are pleased that the court decided to strike $450,514,650 from the jury's award," said Samsung said in a statement. "Samsung intends to seek further review as to the remaining award."
While Apple did not immediately comment, Judge Koh noted the March 2014 trial could determine the patent's cost. The March 2014 trial will feature new patents both companies have alleged infringements, including Apple's iPhone 5 and Samsung's Galaxy S3.
